Straight Comparator #2 - Mr. Herd

NOTE: As you read this post, keep in mind that Mr. Herd was a witness for the defense, so the information he shared on the stand they wanted the Jury to know - well maybe not all of it. . . .


Mr. Herd also attended the Allstate Sugar Bowl - Fact. Mr. Herd helped those investigating me, sending them a screenshot of an IM conversation he initiated, took a screen grab and sent to Mr. Easley the ECO investigator -Fact. Mr. Herd (allegedly according to his testimony) met with Mr. Loizzi MULTIPLE TIMES - Why? We have no idea as none of this was disclosed during discovery, it popped up at trial as AARP tried to hide their discrimination.

While it wasn't his intention (ha!), it is what happened - does his intention matter? I'll note, my mtg with Mr. Easley was on January 31st. Also, the excuse of needing proof to feel safe is just BS to me, Mr. Herd initiated this whole thing (RE: it started with an email post). If he was so "hesitant" to go why did he start this and why wouldn't he tell Pam DuFour at Allstate that we could not attend as he was the only one invited? Why did he make a case on why we SHOULD attend that I took to my manager? This is 100% on him, which AARP knows, but he's the straight guy who got a pass.


Mr. Herd met with Mr. Loizzi multiple times, note he states "meetingS" with an "S" meaning more than one. Interesting that I was interviewed one time, but Mr. Herd met with HR and ECO multiple times. It should be noted that we never recevied any documentation about these meetings, if they occured, any emails to set the meetings up or calendar notifications, notes covering what was discussed, emails or a readout to management, and as I have shared before, Mr. Loizzi's name/involvement did not come up until we were sitting in the court room at trial in March 2024. IF Mr. Herd met with Mr. Loizzi multiple times, then AARP hid this evidence as part of discovery which is illegal!! But if you have been reading my blog, you know AARP is not above lying and being deceitful to try to hide their discrimination. Also, why would Mr. Herd need to meet with Mr. Loizzi multiple times? What were they discussing that took so many meetings?!?

During the investigation, Mr. Easley gave Mr. Herd a pass on knowing it was a semi-final game and if we were allowed to attend those. This man has season tickets to VA Tech, is a HUGE college football fan, had multiple shelves in this office bookcase dedicated to VA Tech with photos of him and his family attending their football games and he said he didn't know that he couldn't go, that he didn't know it was a semi-final game and considered a Valuable Privilege. Once again, he also was never called a liar and he kept his job.

Mr. Herd also claimed that this investigation hurt his chances of being promoted, altho that isn't true. When he left AARP he was a Director, the position I held when I was discriminatorily fired. Also, there was an option of a Written Warning, which was given to both straight men, it is an option for the CEO but Mr. Flanagan chose to terminate the two gay men and it was then shown that we were both discriminated against and illegally fired.

Two straight male comparators, both went to the Allstate Sugar bowl, both were investigated, both were found to be lying during thier investigations but neither were branded or called liars, and both, not only kept their jobs, but were promoted.


It is easy to see why when I could finally get to court and lay out the evidence for the jury, I WON!
